  • Outcome: Case Dismissed
  • Description: Defendant was originally charged with attempted murder (PC 664-187(A)), resulting from a self-defense incident. At a preliminary hearing, the Judge agreed that our client was acting in self-defense, but ruled the force used was excessive. As a result, the Judge held our client to answer to an attempted voluntary manslaughter charge (PC 664-192(A)). In addition, the District Attorney’s Office filed a “gun enhancement” charge, exposing our client to a lengthier prison time. At the trial court we filed a PC 995 motion, asking the Trial Judge to reconsider the decision made at the preliminary hearing. After oral arguments, the trial judge agreed that the force used by our client in self-defense was reasonable and dismissed the case.

  • Outcome: Case Dismissed
  • Description: Defendant was charged with Robbery (PC 211), Assault with a Gun (PC 245(a)), Extortion (PC 524), Criminal Threats/GBI (PC 422), and multiple Enhancements. The maximum exposure was over 15 years. After a lengthy year long investigation by our office for self-defense, combined by zealous advocacy, the District Attorney agreed that our client had a right to self-defense and dismissed the case.

  • Outcome: Case Dismissed
  • Description: Defendant was facing a maximum of four years in State Prison after being charged with an alleged violation of Section 243(d) of the California Penal Code (Felony Battery with Serious Bodily Injury). At the preliminary hearing, the Court agreed that the defendant acted in self-defense/defense of another and dismissed the charge.

  • Outcome: Case Dismissed
  • Description: Our client was charged with one count of Battery (PC 242) and one count of Indecent Exposure (PC 314(1)). After a trial, the Jury found our client Not Guilty on both counts and the client was acquitted.
  • Court: Superior Court of California, City of Los Angeles (Case Number: SA096281-01)
  • Outcome: Case Dismissed
  • Description: Defendant was charged with one count of Second Degree Robbery (PC 211) and was facing 5 years in State Prison. At a Preliminary Hearing the Judge agreed with the Defense and dismissed the case based on Insufficiency of the Evidence.
  • Court: Superior Court of California, City of Los Angeles (Case Number: SA095515)
  • Outcome: Case Dismissed
  • Description: The client was charged with 2 counts of Felony Assault with a Deadly Weapon (PC 245(a)(1)) and was facing 16 years in State Prison. After lengthy negotiations with the District Attorney and review of the evidence, the case was dismissed.
  • Court: Superior Court of California, City of Burbank
  • Outcome: Case Dismissed
  • Description: Defendant was facing up to four years in State Prison for violation of Health & Safety Code Section: 11360(a) – Transportation of Marijuana. After a Preliminary Hearing the Court reduced the charge to a misdemeanor possession (H&S 11357(c)) and allowed the case to be dismissed after the completion of a court ordered drug program.

Verdicts & Settlements Self Defense

 

  • Court: Superior Court of California, City of Los Angeles (Case Number: BA474521)
  • Outcome: Sentenced to much lower term
  • Description: Our client was charged with Murder (PC 187(a) and was facing a 25 years to Life prison sentence. After a lengthy investigation by our office for self-defense and several court hearings, the District Attorney agreed to dismiss the Murder charge and allow our client to plead to a Voluntary Manslaughter charge (PC 192(a)). This resulted in a prison sentence of only 6 years for our client, based on an imperfect self-defense.
  • Court: Superior Court of California, City of Pasadena (Case Number: GA072058-2)
  • Outcome: Sentence to much lower term
  • Description: Our client, along with three others, was facing 25 years to Life in State Prison for violation of Penal Code Sections: 663/187(a) – Attempted Murder, §245(a)(2) – Assault With A Firearm, §32 – Accessory After The Fact, along with numerous Gang Enhancements(PC § 186.22(1)(c)). After over a year and a half of investigation, enough evidence was gathered to prove the Defendant was not directly involved and was sentenced to only six years by the Court.
  • Court: Superior Court of California, City of Long Beach
  • Outcome: No State Prison – Probation Only
  • Description: Defendant was charged with an alleged violation of §288(a) of the California Penal Code (Lewd or Lascivious Acts) and faced up to eight years in State Prison. After a lengthy investigation and negotiation with the District Attorney, the Court sentenced the Defendant to Probation only.
  • Court: Superior Court of California, City of Los Angeles
  • Outcome: No State Prison – Probation Only
  • Description: Defendant was charged with a violation of §11359(a) of the Health & Safety Code (Felony Possession of Marijuana for Sale) and facing up to 3 years in State Prison. The Court agreed to sentence the Defendant to 3 years’ probation. After one year and a half, the Court agreed to terminate probation, allow the Defendant to withdraw his guilty plea and to plea to another related offense. The felony was then reduced to a misdemeanor and case was expunged.
  • Court: Superior Court of California, City of Joshua Tree
  • Outcome: Plead to Lesser Charge
  • Description: Defendant was charged with 3 counts of violating the California Vehicle Code including Driving Under the Influence of Alcohol or Drugs (§23152(a)), Driving While Having a 0.08% or Higher Blood Alcohol (§23152(b)), and Possession of Marijuana While Driving (§23222(b)). After a lengthy negotiation process, the Defendant was allowed to plea to a lesser count of “Wet Reckless” (§23103.5).
  • Court: Superior Court of California, City of Los Angeles
  • Outcome: Case Dismissed
  • Description: Defendant was charged with Misdemeanor Theft, a violation of §484(A) of the California Penal Code. After extensive discussion with the District Attorney the case was dismissed.
