First Offense within 10 Years

If it’s your first DUI offense within a 10-year period, penalties vary depending on whether probation is granted:

With Probation:

  • Attend a 3, 6, or 9-month alcohol/drug program
  • Fine ranging from $390 to $1000
  • Possible jail time of 48 hours to 6 months
  • License suspension for 6 to 10 months (with the possibility of a restricted license)
  • Mandatory installation of an Ignition Interlock Device (IID) for 5 months in certain counties, or up to 3 years in all counties

Without Probation:

  • Jail time of 96 hours to 6 months
  • Fine ranging from $390 to $1000
  • License suspension for 6 to 10 months

Second Offense within 10 Years

For a second DUI offense within a 10-year period:

With Probation:
